The Official Gazette of the Union published last Monday (1st) the decree of the Presidency of the Republic that alters the process for obtaining Italian citizenship.
Last year, Brazil deposited the necessary instruments to implement the Apostille of the Hague Convention, a 1961 treaty that eliminates the validation and legalization phase in foreign diplomatic representations of documents necessary to obtain dual nationality – such as birth and marriage certificates.
The treaty was signed by Brasília in the year of its creation, but was shelved in Congress until last July, when it received approval from the Senate. In December, the Itamaraty initiated the process to implement the convention. Now, the agreement has been promulgated by the Presidency and will come into force on August 14, 2016.
The measure will also benefit commercial, legal and educational transactions, consolidating in a single apostille all the information necessary to validate a document in another nation that is part of the pact, including Italy. This apostille is a type of certificate issued in the country of origin of the interested individual or legal entity and which guarantees the authenticity of the document in question.
The Supreme Court reaffirmed: citizenship is born with the person.

This will make the process of obtaining Italian nationality less bureaucratic. The issuance of these booklets will be the responsibility of a structure yet to be defined by the Brazilian authorities.
