The final version of the 2026 Budget Law, about to be approved by the Italian Chamber of Deputies, maintains the exemption from the €250 consular fee only for children of Italian citizens born abroad from May 24, 2025 onwards. This measure is included in amendment 104.0.14. (text 3), approved by the Senate and which will only need to be confirmed by the House, without any changes.
The Democratic Party (PD) attempted to change this scenario during the committee phase. Senator Francesco Giacobbe, a member of the Democratic Party, presented a proposal to extend the new 36-month period and the free tuition to minors born before the new law came into effect. However, the amendment was rejected.
The government preferred to keep the original text.
The government's base opted to follow the text defended by Italiani all'Estero Associative Movement (MAIE)The organization, which acts as a bridge between the government and the Italian community abroad, had publicly guaranteed that all minors would be entitled to the exemption, which did not come to pass.
MAIE himself accused opponents of disclosing “Fake news” Regarding the topic, it was argued that the fee would be canceled for everyone. However, the final text approved in the Senate makes it clear that the free service only applies to those born after May 24, 2025, the effective date of Law 74/2025.
Contacted for comment, MAIE did not respond.
New attempt at milleproroghe
Faced with the frustration of the Italian-descendant community, MAIE is now betting on a new attempt at change through the traditional decree. milleproroghe (Italian emergency legislation, approved annually, that postpones deadlines and extends urgent measures in various sectors) scheduled for February 2026.
The idea is to present an amendment that includes those born before the new law among the beneficiaries of the exemption.
Until then, the current rule remains in effect:
• Children born before May 24, 2025 have until May 31, 2026 to be registered.
• Mandatory payment of the consular fee of 250 euros
Children born on or after May 24, 2025 will have three years to register and will be completely exempt from the fee.
In both cases, citizenship is granted by legal provision, not by right of blood. (ius sanguinis).
Hope in the Constitutional Court
Many families are now placing their hopes on the Italian Constitutional Court, which will analyze the validity of the Tajani Law. The hearing is scheduled for March 11, 2026..
If the Court declares the new legislation on the recognition of Italian citizenship unconstitutional, the previous rules, which do not impose a generational limit for citizenship by descent, will come back into effect.
